Terms of use

These terms apply when you use the property pages, forms, texts and calls we run for real estate agencies.

1. Who we are

Orgatlas Pty Ltd (ABN 39 679 164 740), trading as The Listing Collective ("TLC", "we", "us"), runs a platform that real estate agencies use to host property pages and forms, reply to enquiries, and keep in touch by text, email and phone. When a page, text or call carries an agency's name, you are dealing with that agency, and we provide the technology on its behalf.

2. Accepting these terms

By submitting a form, replying to a text, or staying on a call with an agency's assistant, you agree to these terms and to our privacy policy. If you don't agree, please don't use them, and contact the agency directly instead.

3. When you enquire

  • The agency receives your details and what you asked for.
  • The agency may contact you about your property and your enquiry, by text, email and phone, sometimes straight away.
  • We only call within the hours the law allows, judged at your address: weekdays 9am to 8pm and Saturdays 9am to 5pm, never on Sundays or public holidays.
  • Property decisions take time, so contact can continue for months or years, until you ask it to stop.

4. Estimates and reports

Appraisals, estimates and market reports on our pages are general information, prepared automatically from market data and the details you give. They are not a formal valuation and do not take your circumstances into account. Please don't rely on them for a financial decision; ask the agency or a qualified valuer.

5. The AI assistant

  • Agencies may use an AI assistant to reply to texts and to make and answer calls for them. It speaks for the agency, uses a name, and tells you it is an AI assistant if you ask.
  • It can make mistakes. It doesn't give legal, financial or valuation advice, and it can't commit the agency to a price, an offer or a contract.
  • You can ask to speak to a person at any time, and someone from the agency will contact you.

6. Recordings

  • Calls with the assistant are recorded and transcribed, and you are told so at the start. By staying on the call you agree to the recording. If you'd rather not be recorded, end the call and contact the agency another way.
  • Recordings are kept for 12 months. The transcript, and any record of what you agreed to or asked us to stop, stay with your details.

7. Stopping contact

  • By text: reply STOP. STOP to an agency's own number stops that agency's texts and calls. STOP to a number several agencies share stops texts from that number for all of them. To start again, text START to the same number.
  • On a call: say you don't want to be called again.
  • By email: use the unsubscribe link.
  • Any time: contact the agency, or us at daniel@thelistingcollective.com.au.

We act on opt-outs straight away and you never need to confirm them. Telling one channel to stop stops the others for that agency.

8. Using our pages, texts and calls

  • Give true details, and only your own unless you have the person's permission.
  • Don't misuse the pages, forms or numbers, send abusive or unlawful messages, or try to copy, overload or interfere with the platform. The assistant may end a conversation that is abusive.
  • Your phone carrier may charge its normal rates for texts and calls.

9. Who is responsible for what

  • The agency is responsible for its services, its advice and its dealings with you. We are not a real estate agent and do not act for you or the agency in any sale or lease.
  • Property information on our pages comes from the agency and others. We don't guarantee it is complete or up to date.

10. Our liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Our pages, estimates and assistant are free to you, and to the extent the law allows, we are not liable for loss from relying on an estimate, a report or general information from the assistant.

11. Changes

We may update these terms. The version and its effective date are shown at the top of this page, and the version in force when you use a form, text or call applies to that use.
