The Listing Collective is committed to protecting the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, when you use our social media and advertising management services, and when you interact with the public property, appraisal, and lead capture pages we host on behalf of real estate agencies that use our platform. We handle personal information in accordance with applicable privacy laws, including the Australian Privacy Principles under the Privacy Act 1988 (Cth).
1. Collection of Information
We may collect information about you in a variety of ways. The information we may collect on the Service includes
- Personal Data Personally identifiable information, such as your name, business or property address, email address, and telephone number, and demographic information that you voluntarily give to us when you register with the Service, when you submit an enquiry, appraisal request, waitlist registration, or booking through one of our public pages, or when you choose to participate in various activities related to the Service.
- Business Data Information regarding your real estate agency, listings, and branding assets uploaded to the Content Hub.
- Lead Data Information collected via lead capture forms and advertising campaigns managed by us or by our agency customers, stored within the Lead Hub.
- Derivative Data Information our servers automatically collect when you access the Service, such as your IP address, your browser type and user agent, your operating system, your access times, and the pages you have viewed directly before and after accessing the Service.
- Tracking Identifiers Cookie and device identifiers described in Section 2, including a persistent first-party visitor identifier we generate, advertising click identifiers, and identifiers set by the advertising and analytics platforms described in Section 3.
2. Cookies and Tracking Technologies
We and our third-party partners use cookies, pixels, local and session storage, and similar technologies to operate the Service, remember your preferences, understand how our pages are used, and measure and improve advertising. These include
- A persistent first-party visitor identifier A randomly generated identifier stored in your browser for up to two years. We use it to recognise a browser across visits, to measure conversions, and to deduplicate events sent to advertising platforms. It does not, on its own, reveal your identity to us.
- Attribution and session identifiers First-party cookies and storage that record advertising click identifiers (such as Meta's fbclid and Google's gclid), UTM campaign parameters, the page you arrived on, and a session identifier, so that we can attribute enquiries to the campaign that generated them.
- Advertising and analytics cookies Cookies set by the Meta Pixel and Google tags (for example Meta's _fbp and _fbc cookies) that support the measurement and advertising functions described in Section 3.
You can control or delete cookies through your browser settings, and you can use the opt-out options described in Section 6. Restricting cookies may affect how some parts of the Service function.
3. Advertising and Analytics Platforms
The Service, including the public pages we host for our agency customers, uses advertising and analytics tools provided by Meta Platforms (the Meta Pixel and the Meta Conversions API) and Google (Google Analytics and Google Ads tags). We use these tools to measure how our pages and advertising perform, to attribute and deduplicate conversions such as enquiries and bookings, to optimise advertising delivery, and to build and retarget advertising audiences.
To support these functions, certain information may be shared with Meta and Google. This can include the tracking identifiers and technical data described above (such as your visitor identifier, advertising click identifiers, IP address, and browser user agent), the events you trigger on our pages (such as viewing content or submitting a form), and contact details you provide through a form (such as your email address, phone number, name, and, for appraisal requests, the suburb, state, and postcode of the property). Where contact details are shared for matching purposes, they are converted into a one-way cryptographic hash before transmission, so that the plain-text values are not sent. This is commonly referred to as advanced matching and server-side conversion measurement.
Meta and Google handle information they receive in accordance with their own privacy policies and terms. You can review how they use data, and adjust your choices, at Meta's Privacy Policy and Google's Privacy Policy.
4. Use of Your Information
Having accurate information about you permits us to provide you with a smooth, efficient, and customised experience. Specifically, we may use information collected about you via the Service to
- Create and manage your account.
- Process payments and subscriptions.
- Respond to your enquiries, appraisal requests, and bookings.
- Deliver custom content and advertising campaigns.
- Measure conversions, attribute leads, and optimise advertising performance.
- Provide analytics and performance reporting.
- Email you regarding your account, enquiry, or order.
- Fulfill and manage purchases, orders, payments, and other transactions related to the Service.
5. Disclosure of Your Information
We may share information we have collected about you in certain situations. Your information may be disclosed as follows
- Agency Customers Where you submit an enquiry, appraisal request, or booking through a public page we host for a real estate agency, your information is provided to that agency as the party you are seeking to contact.
- Advertising and Analytics Platforms As described in Section 3, we share certain information with Meta and Google to measure and optimise advertising.
- By Law or to Protect Rights If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation.
- Third-Party Service Providers We may share your information with third parties that perform services for us or on our behalf, including payment processing, data analysis, email delivery, hosting services, customer service, and marketing assistance.
6. Your Choices and Opt-Out
You have choices about how your information is collected and used
- Adjust or block cookies through your browser settings, and clear stored identifiers at any time.
- Manage advertising preferences directly with Meta and Google through their ad settings and privacy controls.
- Use industry opt-out tools such as YourAdChoices and the Australian industry opt-out resources.
- Contact us using the details in Section 9 to ask about the personal information we hold and to request access or correction.
7. Security of Your Information
We use administrative, technical, and physical security measures to help protect your personal information. While we have taken reasonable steps to secure the personal information you provide to us, please be aware that despite our efforts, no security measures are perfect or impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse.
8. Data Retention
We retain your personal information and business records for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required by law.
